Deposit and Payment - A $100 deposit is required to secure your date. Your date is considered open and available until the deposit is paid. The remainder of your payment will be collected prior to the time of your session by check, cash or credit/debit card. *

Location Costs & Fees - Should the client request a specific location requiring costs or fees, you, the client, will be responsible for the associated costs. The photographer can not guarantee or arrange payment on any location. *

Reshoots & Cancellations - Session deposits are non-refundable. In case of illness or inclement weather, Session deposit may be applied to a new session within 60 days. -You must give at least 24 hours notice in the event of a cancellation to retain the right to a reschedule. - The session deposit is non-refundable and non-transferrable between parties. Extenuating circumstances may be discussed. -Reshoots are not able to be given for clothing, make-up, hair, or child behavior issues. *

Capture and Delivery - Eagle Spirit Photography is not liable to deliver every image taken at the session. The determination of images delivered to the client is left to the discretion of the photographer. -The final post production and editing styles, effects, and overall look of the images are left to the discretion of the photographer. *

Damages and Failure to Perform - The photographer is not responsible for the damage or loss of images after delivery to client. Client assumes all responsibility for the safety and backup of all portraits upon receipt. -If the photographer is unable to perform this contract due to illness, emergency, fire, casualty, strike, act of God, or causes beyond the photographers control, the photographer and the client shall make every attempt to schedule a replacement session. If a reschedule is unable to be agreed upon, the photographer shall return the retainer to the client and shall have no further liability. -If the photographer is unable to deliver photographic materials due to technological malfunctions, including but not limited to equipment operation and image processing, or photographic materials are otherwise lost of damaged without fault of the photographer, liability shall be limited. - Due to the custom nature of the session and product, all sales are final. *

Copyright & Penalty - It is illegal to copy, scan, download, print, share, alter, or otherwise obtain and steal any image created by Eagle Spirit Photography. This applies to blog posted images, Facebook images, gallery preview images as well as hard copy images. Eagle Spirit Photography retains the copyright to all images. With the purchase of your session, you will be given a signed print release allowing you to print your images for reasonable PERSONAL use. *

Model & Photo Release - I grant Eagle Spirit Photography the right to take photographs of me and my family in connection with the above identified event. I authorize Eagle Spirit Photography to copyright, use and publish the same in print and/or electronically. I agree that Eagle Spirit Photography may use such photographs of me and my family with our without my name and for any lawful purpose including, for example, such purposes as illustration, blog and web content. I release Eagle Spirit Photography from any expectation of confidentiality for the undersigned minor children and myself and attest that I am the parent or legal guardian of the children listed below. *

I kindly ask that all clients comply with the model release so that I may display the images from your session on my website, Facebook page, and for using for marketing/promotional/advertising purposes. Signing the model release will allow you to see a sneak peek of your photos on Facebook and Instagram
